Making Small Claims Court Irrelevant

The small claims court system is so yesterday. It's a 20th Century inflexible relic in need of change.

The ecosystem for resolving disputes is undergoing dramatic change as technology and the collaborative effect of the world wide web is providing a new opportunity to re-engineer dispute resolution.

The ecosystem for traditional dispute resolution includes brick and mortar courthouses, judges, lawyers, mediators, clerks, forms to fill, sheriffs to serve court papers, limited parking, courtroom rules, and collection agencies. This ecosystem is highly complex, inflexible, and inefficient. What we need is simplicity.

Clay Shirkey, the prolific writer and lecturer on how the Internet will change institutions, wrote a blog post in April 2010 titled The Collapse of Complex Business Models.

In that post he wrote:

"When ecosystems change and inflexible institutions collapse, their members disperse, abandoning old beliefs, trying new things, making their living in different ways than they used to. It’s easy to see the ways in which collapse to simplicity wrecks the glories of old. But there is one compensating advantage for the people who escape the old system: when the ecosystem stops rewarding complexity, it is the people who figure out how to work simply in the present, rather than the people who mastered the complexities of the past, who get to say what happens in the future."

We have figured out a simpler system that will dictate future dispute resolution. We will get to say what happens in the future.

The new ecosystem for dispute resolution will include only three key elements: 1) parties to a dispute; 2) a distributed network of unlimited jurors across the globe; and 3) a website for jurors to vote on the outcome of a dispute. Crowdjustice.
